Terms of Responsibility

1. Identification of the Organizer and Scope

This document sets out the Terms and Conditions applicable to the “Equator Crossing 2027 – Swimming & Travel Experience” Travel Package, to be held in São Tomé and Príncipe from 10 to 17 February 2027, including the travel programme and, where purchased together with the Package, registration for one of the associated swimming races.

Registrations for the races only (Race Only) are governed by separate registration terms and conditions and are not subject to these Terms and Conditions.

Registration constitutes acceptance of these Terms and Conditions, without prejudice to the mandatory rights granted by law to the traveller/consumer.

EquatorCrossing Ltd acts as the organiser of the Package in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018.

2. Nature Of The Event — 4st Edition

For the purposes of these Terms and Conditions:

“Trip” means the EquatorCrossing tourism programme taking place from 10 to 17 February 2027. “Event” means the series of sporting and open-water activities associated with Equator Crossing 2027. “Races” means the Equator Crossing, Middle Distance, and Sprint events. “Participant” means any person registered for the Trip and/or for one of the Races.

Equator Crossing 2027 is the 4th edition of the event.

The Races will be timed, and participants' personal finish times will be recorded. For this edition, no official refereeing or national or international federation sanctioning is planned. Accordingly, all times and results will be provided for informational and personal reference purposes only and shall not constitute officially recognised records.

3. Registration And Payment

3.1. Travel Package

Registration for the Trip shall be completed by submitting the registration form and making payment in accordance with the conditions set out in the Travel Programme.

The prices applicable to the accommodation options are specified in the Travel Programme. Special occupancy arrangements, including three persons sharing a room or bungalow, are subject to availability and confirmation.

Before completing registration and making payment, participants will be given access to these Terms and Conditions and to the Travel Programme, which together constitute the specific pre-contractual information applicable to the booking. Registration may only be completed after the participant confirms that they have read and understood this information and accept these Terms and Conditions.

The price stated for each accommodation option is the final price per participant and includes all taxes and charges applicable to the contracted service, except for those services expressly identified as not included in the Travel Programme. Payment shall be made in a single instalment using the payment method made available on the website.

3.2. Minimum Number of Participants

The Trip is subject to a minimum of 10 participants with confirmed and paid bookings.

Confirmation that the Trip will proceed shall be communicated in writing as soon as 10 confirmed and paid bookings have been reached or, at the latest, 90 days before the date of the event.

If the minimum number of participants is not achieved, the Organiser may cancel the Trip and shall provide a full refund of all amounts paid by the participant in respect of the Trip, without any additional compensation, within the maximum period permitted by applicable law.

3.3. International Flights

International flights to and from São Tomé and Príncipe are not included in the Trip price, are not sold, booked or arranged by EquatorCrossing, and must be purchased directly by each participant.

Participants should not purchase airline tickets until they have received written confirmation from EquatorCrossing that the Trip will proceed.

If a participant chooses to purchase air travel before receiving such confirmation, they should first verify the change, cancellation and refund conditions applicable to the fare purchased.

Any costs associated with airline tickets purchased directly by the participant shall be subject to the terms and conditions agreed between the participant and the airline or intermediary through which the purchase was made. Such costs do not form part of the Trip contracted with EquatorCrossing, without prejudice to any rights granted to travellers under applicable law.

3.4. Registration for the Races

Registration for the open-water swimming races is optional and separate from the Trip price, in accordance with the pricing schedule set out in the Travel Programme.

The Races have a limited number of places available. A place shall only be considered reserved and confirmed in accordance with the registration and payment conditions communicated by the organisers. The Travel Package may be purchased without registration for a Race or, where this option is available during the booking process, with registration for one of the Races.

Registration for a Race only (Race Only) is independent of the Travel Package and is subject to its own Registration Conditions, Event Regulations, Liability Waiver, and any other applicable documentation.

The opening and sale of registrations exclusively for the Races shall be carried out through a separate process that is independent from the booking and purchase of the Travel Package.

4. Cancellation, Changes And Refunds

4.1. Cancellation by the Participant The participant may cancel their participation prior to the start of the Trip by providing written notice to the Organiser. Without prejudice to any mandatory legal provisions that may apply, the following conditions are proposed:

Cancellation notified up to 90 days before the start of the Trip: 100% refund of the amount paid. Cancellation notified between 89 and 30 days before the start of the Trip: 80% refund of the amount paid. Cancellation notified less than 30 days before the start of the Trip: cancellation charges permitted by law shall apply, taking into account any non-recoverable costs actually incurred and any savings or reallocation of services that may be achieved.

Participants are advised to obtain cancellation insurance appropriate to their personal circumstances.

4.2. Cancellation by the Organiser

If the Trip is cancelled because the minimum number of 10 participants has not been reached, all amounts paid to EquatorCrossing in relation to the Trip shall be refunded in full within the legally applicable period.

The cancellation and the corresponding refund instructions shall be communicated to participants in writing.

4.3. Unavoidable and Extraordinary Circumstances / Changes to the Programme

The safety of participants shall take precedence over the full execution of the itinerary. Unavoidable and extraordinary circumstances, adverse weather or sea conditions, decisions by the authorities, or other relevant safety factors may require changes to the programme.

Any significant change shall be communicated to participants as soon as reasonably possible and shall be handled in accordance with the rights and obligations established under the applicable legislation.

5. Insurance

The price of the travel package does NOT include travel insurance, cancellation insurance, or international medical assistance insurance. a apresentação da apólice ou do respetivo comprovativo à chegada. Individual travel insurance is mandatory for all participants in the Pack. It must include, at a minimum: medical expenses with coverage of at least €1,000,000, evacuation/repatriation, and explicit coverage for open water swimming, when the participant intends to carry out training sessions or Races included in the experience. The participant must send to the organization, by email (info@equatorcrossing.com), proof of valid insurance up to 15 days before the start date of the Trip. The organization may request the presentation of the policy or its respective proof upon arrival. EquatorCrossing — Terms and Conditions | Sep 17, 2026 Failure to send the proof within the indicated deadline must be resolved before the start of the Trip, under the terms communicated by the organization.

6. Participation Requirements

• Minimum age to participate in the swimming races: 16 years. Participants aged 16 to 18 must present written consent from a parent or legal guardian. • All participants must have the physical capacity and swimming level appropriate for the distance of the race they register for, and it is their responsibility to correctly assess this suitability. • A prior medical consultation (travel medicine and/or physical fitness evaluation) is recommended before the trip, especially for participants with pre‑existing health conditions. • Any relevant medical condition must be communicated to the organizer before registration, for assessment of suitability. Participation in the Races is subject to compliance with the requirements set out in the Equator Crossing 2027 Regulations, namely regarding the minimum age, physical fitness, and swimming level appropriate to the chosen distance, required documentation, check-in procedures, and mandatory equipment. Participation also entails the submission of the Liability Waiver and Informed Consent, where applicable. When registration for a Race is purchased together with the Pack, the participant must know and accept the Race Regulations and the Liability Waiver and Informed Consent, in addition to these Terms and Conditions. For Race Only registrations, the respective standalone Registration Conditions apply.

7. Water Safety

Open water swimming activities will be carried out in accordance with the Equator Crossing 2027 Regulations and with the Safety Plan defined for the event, including the means of monitoring, surveillance, assistance, and emergency procedures appropriate to the nature of each activity. The participant must comply with the organization's instructions and use the safety equipment defined as mandatory in the Race Regulations. For safety reasons, namely depending on weather, sea conditions, or other circumstances likely to compromise the safety of participants, the organization may suspend, postpone, modify, or interrupt an aquatic activity, without prejudice to legally applicable rights.

8. Assumption of Risk and Responsibility

Participation in open water swimming involves risks inherent to practicing sports in a natural environment. The participant declares that they are aware of the nature of the activity and undertakes to comply with the safety instructions, the race regulations, and the organization's guidelines. The Organizer's liability will be determined in accordance with applicable legislation, and these Terms may not exclude or limit rights or liabilities that cannot legally be waived.

9. Image Rights

The participant is informed that EquatorCrossing 2027 includes activities and events held in public and open spaces, during which photographs and video recordings may be captured, including aerial images by drone. General, panoramic, ambient, or group images may be processed on the basis of legitimate interest, under the terms described in the Privacy Policy. The use of images in which a participant is individually identified, highlighted, or constitutes the main element, namely portraits, interviews, testimonials, or individualized promotional content, depends EquatorCrossing — Terms and Conditions | Sep 17, 2026 on autonomous and explicit consent. The document "Consent for Capture and Use of Image" will be made available separately, allowing the participant to authorize or not such individualized use. The decision does not condition participation in the Trip or in EquatorCrossing activities.

10. Personal Data Protection

The personal data collected will be processed only for legitimate purposes related to registration, execution of the Trip, organization of the Event, safety, billing, and necessary communications, under the terms of the applicable privacy policy. The data controller is EquatorCrossing Ltd. Data processing will be carried out under the terms of the UK GDPR and the Data Protection Act 2018 and, where applicable to data subjects in the European Union, the applicable mandatory data protection rules. The Privacy Policy identifies the purposes, legal bases, recipients, international transfers, retention periods, and rights of data subjects. Contractual/billing data will, in principle, be retained for 6 years; health data will be deleted after the event, except where it must be retained due to an incident or legal obligation; marketing data will be processed until withdrawal of consent/applicable objection. 11. Complaints

In accordance with applicable legislation, a complaints book is available in both physical and electronic format. The electronic complaints book can be accessed through the link provided on the event website, in a clearly visible location.

12. Emergency medical assistance

You authorise the organisation to arrange first aid, rescue and transport to a medical facility if that becomes necessary, and you accept the cost of any treatment or transport that your insurance does not cover.

13. Limits of the organisation’s liability

The organisation is responsible for running the event with the safety measures described in the Event Regulation. Within the limits allowed by law, it is not liable for injury, illness, loss or damage that results from a participant's own health, from their decision to enter the water, or from failing to follow safety instructions. Nothing here limits liability that the law does not allow to be limited.

14. Acceptance

Ticking the Terms of Responsibility box during booking has the same effect as signing this document. The organisation records the acceptance together with your registration.

15. Lei Aplicável e Resolução de Litígios

These Terms and Conditions and the Pack contract are governed by English law. Without prejudice to the mandatory consumer protection rules applicable to the participant, disputes will be submitted to the courts of England and Wales. Consumers residing in other States, including Portugal, retain the mandatory rights applicable to them under the relevant rules of private international law.

PRE-CONTRACTUAL INFORMATION AND TRIP DOCUMENTATION

Before the participant becomes bound to the booking and before payment, the essential information relating to the Trip will be made available in a clear and accessible manner, integrated into these Terms and Conditions and the Trip Program, namely: • full identification of the seller/Organizer and their respective contacts; • destination, dates, duration, itinerary, and main characteristics of the services; • accommodation and respective occupancy type; • total price per participant, including applicable fees and taxes, as well as the services expressly not included; • payment in a single installment through the website; • minimum number of 10 participants and deadline for notification of the Trip taking place or being cancelled; EquatorCrossing — Terms and Conditions | Sep 17, 2026 • cancellation, change, and refund conditions; • information regarding the required individual travel insurance and the protections/insurances legally applicable to the Organizer; • entry requirements, travel documentation, and applicable health information, when confirmed; • information about the optional Races and reference to their respective Regulations; • reference to the Privacy Policy and information regarding the capture and use of images. The pre-contractual information thus forms part of these Terms and Conditions and the Trip Program, and no additional standalone document is created. The participant must have the opportunity to consult these documents before declaring their acceptance and before making payment. Before completing the booking, the participant will have access to the Official Program, these Terms and Conditions, and the legally applicable pre-contractual information. Legal Provisions

These Terms and Conditions must be made available to the participant before completion of the registration and kept in a durable medium. The version applicable to each booking will be the version made available and accepted at the time of contracting, without prejudice to changes subsequently agreed upon or legally required. VERSION — Before publication, replace the revision indication with the number and date of the final version. The version applicable to each booking will be archived together with the record of the participant's acceptance.
